Panicking Before Submitting! Please help!

I've checked all the related posts. My situation is probably close to that of Pal-bay's who's got approved (Congratulations). Here are the run-downs-

Submitted I485: 5/2000
GC approved: 5/23/2001

Left Employer: 4/30/2001

Yes, I know -I could have waited a bit longer. But my dad was under a serious health condition at the time, and I had to go back to my home country. Since I didn't know how long my leave would be, I quitted. However, my dad turned out ok. And I returned to US within 30 days. But didn't feel like going back to my old job. And I haven't been working much since. My hubby worked. On my N400, I'd list only one dept. store sales part-time job. Not the field I got gc in. Then I started my business last year, not really in related field either. So there are only 2 jobs on my 5 year employment history.

Would all this post threat to my gc status when my case is reviewed? Would my gc be considered fraudulent? I'm panicking. As I don't want to jeopadize my hubby and my own gc.

I read about pal-bay's posts. I think my situation is similar to his wife's, except that she's actually worked a couple of same field jobs after gc. I feel that my situation is a little worse than hers.

Work history is not an issue at all as long they are legal and you have paid taxes on the earnings.

Please be prepared to provide the documentation to prove work history (pay stubs etc) and Last 5 year tax transcripts.

From what I have gleaned from all the postings, the IO checks:
1. Residency requirement.
2. Moral character (arrests, dui etc).
3. Ability to speak and write English.
4. Civics test.

Hi,

Did your hubby file for your GC or you got derivative GC off your hubby.

If you did receive it off of your hubby it does not matter when you worked for your employer etc etc.

If the above is not the case..get as much proof of whatever you described e.g pay stubs etc.(maybe even doctor's certificate for your fathers condition, hospital record etc) to prove your case was genuine.

search on this forum for similar experiences.

Waiting, my hubby got his gc from me. I'm primary. That's why I'm worrying so much.

I can get med records of my dad, but it'll be from my home country, and I'm not sure if there is any legal requirements of such records.
 
Not a big deal. You're not required to be employed to become a citizen. The fact that you left your employer in now way affects either the validity of your Green Card or your eligibility for citizenship.

The only concern that's been expressed in the past is possible fraud if you got your GC under the premise of working for company A and then immediately turned around and worked for company B.

That's not the case for you. If your IO asks you why you left, just say you had a family emergency that you needed to attend to and couldn't continue being employed while you were spending time with your fam.

If they ask you why you didn't go back to work, you can always give them some "bad economy" BS or something of that nature. And that you were preparing to start a fam/business/whatever...

Wait, you left your Employer a month before you got your Green Card? IF that's the case then wouldn't that be a issue since a month had gone by where you didn't have your green card and were not working for the sponsoring company.

Or was this a typo that you quit less then a month after getting the Green Card?
 
You might want to post your question on the I-485 forum board.

There is probably a rule (have forgotton the specifics after all these years) where you can change jobs after 180 days after applying for I-485.

You most probably had an EAD which is given in place of a H1. H1 is a non-immigrant work visa but when you applied for I-485 (change of status application) your H1 is not valid.

You might want to know if you can quit your job and remain without one while on EAD (before you were granted the actual GC, when you could quit, and if laid-off be granted unemployment benefits).
 
In any event, they ask for job history in the last five years and nuances of the job history in 2001 may not come up.

Wrong.
Applying for I-485 does NOT invalidate your H-1. Even if you apply for EAD, get EAD and have it in your pocket - your H-1 stays fine, until the moment you start actually using your EAD (show it to the employer and fill the form with the date stating change your 'work' status from H-1 to EAD).

You have a point. However, ny11023 probably had an EAD towards the end and used it and hence invalidated her H1.

The question is, can you change jobs/quit after you get your EAD? She'll have to ask in the right forum as the people there are more up to date on the rules.
