My younger brother was visiting us on a B-2 visa. While he was in the US, we applied for a change of status from B-2 to F-1. We sent the application before the expiration date on his I-94. While he was in the US, we received a letter from the INS requesting for more information. However, my brother left the US soon after we received the letter from the INS.
My questions:
(1) Will his extended stay (beyond the date on I-94) in the US be considered as an "over-stay"?
(2) My brother has a 10-year multiple-entry visa. Will he be allowed to enter the country if he wants to visit us?
(3) He may apply for an F-1 visa. Is the probability of visa denial higher due to his change of status application (B2 to F1) in the US?
