Hi,
I'm trying to determine, whether my niece would be able to qualify as under 21 with or without the CSPA act. A lot of information is available out there - but I'm still unable to figure out the final outcome!! Is she going to make the cut OR is it even going to matter? I've listed the pertinent info below - would definitely appreciate comments & / or suggestions. Thanks in advance.
Details:
My mother is a US citizen and she filed the I130 for my sister & niece (derivative), under F3 category. The derivative was under 21, when the application was filed & approved.
1. DOB= Aug 1983
2. Date I130 filed= Feb 1999
3. Date I130 approved= May 2000
4. Date I864 & visa fees filed= Feb 2004
4. DS-230, part-I filed= Mar 2004
