outside US after interview w/name check pending

After I received my interview notice I accepted a job in Vancouver, Canada. I had never heard of FBI name check and didn't think I would have problems with security clearance. The officer even gave me verbal assurance that I would "probably" be cleared within 2 or 3 months after interview. Its now 11 months since interview and I am obviously in name check black hole.

But I am residing outside of US working on contract that will end late December 2007. I am still receiving mail at my apartment in Dallas. My roommate communicates with me once a week. I don't pay rent but the phone and internet is in my name. I still have US bank accounts, credit cards.

Should I file N-470 to preserve my continous residency or file 1447(b). I can return to Dallas early December for a few days to file papers.

I work in visual effects and animation. It is an unstable industry and a lot of work is leaving US. I am working on an animated film and the production company is American. The funding is mostly US dollars and the product will be targeted to American audience.

A lawyer was going to file 1447(b). I thought she would do this last summer ... but she hasn't yet, just e-mailed an inquiry at the DO and billed me a lot of $$ (over $4K .. I am pissed). She doesn't think I need to worry about continuous residency ... so long as I return to US for a few days every 6 months.

So ... I feel like time is running out for me ... I'm not sure if I qualify for the N-470. I'm not sure if I can handle the issues of 1447(b) on my own while I am outside US.
