Out of status

Hi,

My brother graduated in May (F-1 visa). He will be leaving the US in August (confirmed). However, that would mean he has over-stayed the 60-day time period within which to leave the US, after completing studies. This would make him out-of-status.

Now, what are the consequences? Will he have any problems if he has to come back later on an F-1 or H-1B visa? or green card processing (family based)? My mother is a green card holder, and applied for him.

Any suggestions/help in this regard is greatly appreciated.

In any case he should not stay in the US beyond his 60 day limit. This would affect his coming into this country later on. If he has to stay, then he should take the admission in the school, and then close to his departure date, drop and go back. He can say he has family emergency back home, so he has to leave.
