Out of Status!

A friend of mine, came into the US on an F1 visa and since the last 12 months, he has been out of status. INS has given time till
June, 02 for him to leave the country. (They got to know about his status recently while travelling on a greyhound bus).

If he gets married to a US citizen, will he have trouble getting a GC. I heard there\'s a rule that says, that if a person is out of status on a temporary visa for more than 180 days, then they will reject his GC, when he applies for it.

Yes it is true. Actually your freind will be barred for 8 years for 1 year out of status. He is actually very lucky that he was not arrested and deported, they would have done it if he was a Arab.

There is a law 245i, which gives indefinite amnesty, but that expired on apr 30.

What to do next if it took more than 180 days and has recenly married

I am in the same position, I came on F-1 visa and became out of status since 1 year, and have recently married a girl and now am planning to apply for a GC. After reading the above discussion, I would like to know what should I do next. Is it possible to apply for GC now or should I leave this country with my wife which is a very big challenge.

What to do next ??

If a person is out of status and is living here for a period of one year,what is the best thing for him to do/what are the possibilities:

- should that person marry some GC holder and then apply for GC through a lawyer or by himself?
- If that guy has secured admission in another very good university in euorpe, Can/should he apply for his visa from within USA for that country without leaving. Could there be any effect of this on his new visa to that country.
- what if any out of status student applies for immigration to canada while without leaving USA. Is it better/worse to apply from within USA rather than from his home country
