Out of Status??

hey everyone!
I came to the US in Fall 2003 .. on F1 visa ..completed my Masters and .. graduated this semester i.e Spring 2005
My OPT has already started ..(5/14/2005 - 5/13/2006) and currently i am working for an employer...
Now .. the thing is .. the employer does not wish to file for the H1 for Oct 2005 .. instead he says .. we will file it for the 20,000 quota for 2006 which will be in March ...
He says .. if something goes wrong that time .. then we file it premium processing on April 1 2006 for the Oct 2006 quota .. so that u can have the approval in 15 days ..
But wont i be out of status ?
I am like totally confused right now ...
Please help me out !

Hi,

If you file on April 1 2006 for oct 2006 quota, your H1 validity date starts from Oct 1, 2006 which means you will not be able to work during that period.
