I'm Ramu. I need your advice that stamping is required or not for my situation:
I will just outline briefly about my situation:
I worked for Employer A for 1.5 years in US and holding their visa in my passport which is valid until Dec 2007. I moved to employer B and employer B applied for H1b transfer and I began working with them after getting the receipt notice. After working 4 months for employer B, my H1b transfer with company B got rejected in Jun'06 (since compB was block listed some time back for their misuse of H1b's) and I went out of status because during this time Comp A has revoked my H1b with them. After that I returned back to India with in a week, and I filled my H1b with Company C and it got approved.
Here my Concern is:
When Comp C's attorney applied for H1b extension, he applied the new petition to be processed with Delhi Consulate. Hence it is mentioned in the newly approved I-797 that POE: US consulate, Delhi.
When I contacted one of the well-known attorney's in US, I came to know that I can come back on Old visa itself because it valid until Dec 2007.
But Surprisingly Comp C attorney's informing me that I need to go for stamping on their H1b Visa.
I'm very much confused to go for stamping or not.
Team, If any one of you faced similar scenario, Pls let me know Can I come to US on Old visa itself ?
