My husband, father of our 5 year old, is Irish, entered legally on a student visa, should have returned 5 years ago, now out of status. We married in May of last year, filed the i130 form, they are stating that he is not allowed to file the I485, because he has been out of status for too long? Everything I have seen or heard is that when you marry an american citizen, all that is forgiven. They are saying he has to return to Ireland to have his interview and do everything from there? We will lose everything if that happens, the house, car etc etc??? Does anyone know anything about this situation and if anything can be done to avoid him having to go back to Ireland, leaving his family behind.
