Our RFE details and pl advice.

For Me,
1. One year W2 and Tax returns
2. Employment letter on company letter head that sponsored my I-140 (Actually I changed my employer after 10 months of filing I485). The letter should have details of my current salary, duties and companies willingness to continue me.
3. Last six months pay stubs

For my wife:
1. Date of birth, it should have timely registration, parent’s names, place and date of birth (Actually we submitted one with our I-485 application).

Please answer to the common question,

• I can not get a letter from my previous company, so if I send the employment letter from the current company is it OK?

• For my wife’s birth certificate, do we have to get affidavits from her Parents?

Not sure on [2] on ur RFE..Wait for some experts to answer this.
U must be fine with [1] and [3] I guess.
I guess for [1], u have to provide an employment letter and current should be fine...But dont' go by my words, I am just putting forth my thoughts...INS wordings can confuse you, but they might just expect 'an employment letter'. Let the ones who got one, and replied and got approved clarify this..!

W.r.t your wife's RFE, do get two affidavits for your wife's BC, as a support document . What did the one you submitted contain?
 
I have seen some of the RFE's asking for letter from sponsoring Employee. But most of the candidates produced letter from current employer and they all got approved. Make sure that your Employer letter says that you have joined their company using AC21 law.Look for sample letters in the First thread in this page

For my wife's BC, we have submitted one, which we got from MRO office, that has all the details what BCIS expects, I don't know why again they requested for it. Any how I am trying to get Affidavits from India.

Is it possible that your wife's Birth was not registered at the time ofher birth but at a later date? If yes, that might be the reason for the RFE for her.

You are right, but my BC also I took at the same time(in 2001), any how for my wife's case if I provide affidavits from her parents' is it enough?

Thank you for your reply, I am also in same boat and I have also same case as of you and INS issued REF on 08/06/03 on my case.

RFE issued: 08/06/03 (don't know the detail)

When Online message changes to RFE received.

I have submitted my RFE package, and according to FEDEX BCIS received them on 09/16, but online message is still showing the old message that they sent an RFE to us.
Any Idea, when the BCIS Online message will be updated with my RFE received details.
