Our marriage is real but we have a terrible relationship right now. We don't get along and just many personal problems. We don't even sleep on the same room sotmimes Would this be a problem if asked about at the citizenship interview? I mean, everything about us is real, we're just not doing well. Please respond if any of you have experienced this type of situation or know anything about it. Thanks

Do you already have a 10-year green card? Are you applying for citizenship based on having a green card for 5 years, or are you applying with the marriage-based 3-year rule?

Victim of marriage fraud :(( can he still get his green card??

Hi all,

Unfortunately I am another victim of marriage fraud. My ex-husband used me to obtain a green card, he holds the conditional green card now and is waiting to remove conditions to get his permanent. I just think it is so unfair for him to get a green card based on my love and kindness for him. Basically he was emotionally abusive to me, he pushed me a couple of times, spat on me and threw a cigarette at me. I thought this was a part of his personality and was waiting
for him to change, which he didn't. After he got his conditional card, a month later he cheated on me...I was shocked beyond words, I couldn't sleep or eat for days. I was soo heartbroken because I gave everything to this man, he was my first. And he just completely took all advantage of me. He cheated on me with a woman who had 2 kids. He even threatened to kill me once. And I wanted an annulment, but he didn't let me get it, not even a divorce. I had to wait when he agreed to divorce because that was convenient for his green card. I was scared of him so I agreed. But he moved out when I found out he cheated on me, which was 6 months after the marriage. And we divorced 15 months later.

I know he can apply for i-751 waiver. Do you think it's likely that he will get his green card? I sent a letter to USCIS telling them everything that happened, but I told them to keep the letter confidential because he threatened me if I try to do anything. Do you think my letter will do anything? I also included printouts of the number of the woman he was texting when he was with me, not the texts, but just the number...and he also admitted to me that he used me..Thanks.

no. will be applying for the 10yr GC very soon, which then will apply for USC based on 3 yr marriage.
that's the plan anyway.

For the I-751 which you'll file to get the 10 year card, 80-90% of the time they don't require an interview. So they'll probably base their decision only on the documents you send, and you're still living together so you shouldn't have a problem with gathering those documents. And if there is no interview they won't get into details like whether you're sleeping in the same room.

But you'll have a problem if your spouse is not willing to sign the I-751. Do you know if your spouse will sign it?

After the I-751, if your marriage really falls apart and you can't apply successfully with the 3-year rule, you can wait another 2 years and apply with the 5 year rule.
