I just scanned over the FAQ..so I hope somoene is online to just clarify something for me.
I am a US citizen, my husband is not- so we would be applying for his GC. We lived out of the country (me since 1994) but are now returning for health issues for our child. We are in the US now.
He owns a successful business and has income from it ongoing. It has always in the past suited us to file US tax Married/Separate...Therefore, my 'income' is very low (under the poverty) although we have assets and are somewhat immediately liquid-at least enough to get through I think.
There will be a family of 3 of us in total. I have documentation that we have approx $75k in our account (combining one account in the US and the other country). Everything we own either country is joint (except he owns the company)..We own real estate in both places as well...
Anyway..my question is this...I received info that my income has to be 3xs the poverty level..but I am also reading 5 times tonight here.....Is that 3x's the 125%???
I am to assume that $75k is not enough? Also...what about the fact that he will still obviously be receiving funds from his business abroad while here..ARe they really going to just look at MY income (per tax form) OR are we ok you think..
What about the 2008 section where it asks for income? My return is not yet done (and the 2008 will be fine as far as above the poverty level). But, can I bring this to the interview as additional documentation for the officer to further prove this?
Or..should I just get a co-sponsor now? I don't want a problem (ie...not enough funds) when I can get a sponsor ahead of time..
If we had seen this coming we could have structured ourselves diffferently (tax/businesses wise), but this was an unforseen move.
