Our FBI NNCP Experience

First of all thanks to Rahul Kumar for sharing all the info in the "My name check experience thread". I agree the system is slow but works if you have patience & persistence.
Finally i got my name check done on May 3rd & got an email from FBI on May 4 05. This was after we did FOIPA, sent emails, certified letters (Cannon/Hooton) and also initiated congressional enquiry. Sanitised FBI email is below. Hopefully we will get our GC approval soon.

Dear Mr. XXXX,

I am responding to your e-mail dated May 2, 2005 and your letter dated April 21, 2005, requesting status for an FBI Name Check.

A review of the FBI's Name Check Program database concerning Sanjay XXXX revealed a request was received from the United States Citizenship and Immigration Services (USCIS) on May 19, 2004 and it was completed on May 3, 2005. The results were forwarded to the USCIS Headquarters in Washington DC.

A review of the FBI's Name Check Program database concerning Ritu XXXX revealed a request was received from the United States Citizenship and Immigration Services (USCIS) on May 19, 2004 and it was completed on July 23, 2004. The results were forwarded to the USCIS Headquarters in Washington DC.

I saw several cases reported on this forum that name check was cleared the day after inquiry. Does that imply that FBI is often triggered by you inquiry to clear the case?

I've sent out a few emails, but as expected, no response yet. Did you try out the fax option?

Also, how did u find out that ur case was pending name check? i want to follow ur process too.

Our Name Check Process

1. Certified letter: search for a thread from Rahul Kumar - My name check experience in the forum which has all details including physical addresses for certified letter. Send a letter asking for a status report & asking FBI to expedite as it is pending. More info on the name check thread.

2. Did a congressional enquiry for USCIS status & they advised that name check is pending.

The sanitized letter shows dates in 04, your signature shows FP of 2/05. Can you please clarify the year/months please?

Our Name Check experience

Name check request is independent of the FP request, hence different dates, but both activities need to be completed before adjudication of AOS. Hope that helps.

Thanks for the clarification Sanjay. I would guess that in Mr. S's case name check was held up until receipt of FP results? In the case of Ms. Ritu Name check got cleared right away. It is interesting to know that name check can be independent of FP check.

Following on, it means that those who do CP don't have to go through this process because as soon as their file is received at NVC it is mailed to the consulate if a visa number is available.

I got my name check cleared on April 21, 2005 but till now, my I485 is not approved. Do you know of any case which got approved after the name check process? Also, how long it will take after the name check has been cleared.

EB2 I140/485 concurrent - March 15,2004
I140 AD: Feb 23,2005
FP: Sept 30,2004

Name Check

No i donot have any trends or examples but hopefully approval should be around the corner once TSC systems pick up the name check clearance.

I have sent a certified ltr to Mr.Hardy as of may 2nd week, so far no responce, i an following Mr.Rahul Kumars notes , i got the FIOPA in Nov 04. Can you please tell me who else we can send letters to.

Michael Cannon is the NNCP chief now.

My name check is cleared as of may 10 th, upon following with NNCp I came to know abt this, I am waiting for approval it took so long, I think once the name is cleared it should come, i had intrvw at local office and the officer told this. Thank sanjay.
