OT: Refund from USCIS

Gurus,

I sent a cashier check to update my H1 application for premium processing on 11/21. But they already processed my application.

Is there a way to contact USCIS and get the refund of my money as I never used their services ?

I feel that I have been cheated. Thanks in advance.
 
That's funny (forgiving me for laughing).
Anyway, just contact them via phone or write to them and see if they respond.

When did you file H1 and how much did you send for premium processing , is it $1000..

I applied for extension on 9/13 and on 11/21 I sent a check for $1000.00.

Does anyone have a number to call ? Appreciate your help.

When did you get H1 cleared? Maybe it was because of premium request.
I think if you contact them and if they have not done premium processing, then they would send the check back. Did you call them already?
 
I don't think any of the check is refundable if you read the forms more. Sorry to hear about this. Call them 1-800 number and double check.

Yeah, if the case is rejected or approved. What if no action required? They can't do premium processing for a case which is already approved.

My case was approved on 11/20 before even I submitted the request for upgrade(My lawyer did that on 11/21).

Can anyone please give me contact # ?

On a lighter note, if you want your greencard please don't ask for refund :) on H1. They will remember you and make you spend the same money on I-140. I know you are feeling cheated by uscis, there are number of us feel the same way for retrogression :).

Check you can do a stop payment on the Money Order, if your H1 is approved before uscis received the check.
 
That'll be really sad if you loose this money because it is non-refundable.

On a different note, most of us have lost (and are loosing as I write) thousands of dollars every year because of USCIS. Retrogression is forcing most of us to work for one employer even if we can find other high paying jobs.

Note the check number and ask ur bank not to process it. Call USCIS and notify them that ur case was processed before u sent the check to upgrade it to premium processing, hence u are stopping the payment on that check. Then also put it in writing, and send a letter to USCIS at the same address where u sent in ur application and check, send it by registered mail, and keep a copy with u.
 
I spoke with my lawyer and he says that it is upto DOS to decide how many and to whom they may hand out GCs.It is upto their will.

For instance,this may have to do with outsourcing to India or India not sending its young men and women to war .. only god knows why ! We are able citizens of able nation .. lets not regret ..enjoy life !

It is your employer who paid the money....

It is your employer who paid the money for your H1 processing. So, be very careful what you ask for! Losing $1000 is one thing and inviting an investigation on your employer (and ensuing consequences) is another! Just stay put, they will refund. Or your employer shd ask for refund & not you, after a month or so!

When I first sent for extension of stay, I paid the fee per applicant in 3 checks and USCIS returned 2. So, I would say stay put, they will return yr CO to yr atty.

My lawyer sent a fax to USCIS to get the money refund. She said she received a call from them and looks like I may get my money back.

Makes me feel better :D
