Original Birth Certificate

Hi,

I am applying for I-485 - AOS, and I have lost the original Birth certificate. It is going to be very difficult (impossible) to get a duplicate or a non-avaiklabiliy certificate as my place of birth is in a remote place and I have no one back there to get it for me.

I do however have the photocopies of the birth certificate. I know with 485 you need to submit the copy only. My question is that is there any chance of BCIS asking for the original Birth certificate during 485, EAD or AP, FP etc., once I have submitted the copy (it is not attested) ? Does BCIS care about the original birth certificate? Has anyone got RFE for original BC ?

I think most probably you won't need orginal brith certifcate,

When you send any paper to INS, usually you sign the peice of paper that says you are autheticating all the document by your self (I don't remember exact word, but something like you certifying all the photocopy your are sending are true copy and you will send orginal if INS asked for)

So basically I haven't heard anyone when they asked for orginal birth certifcate or any orginal copy of any certificate, but it's not imposible for INS to ask orginal copy so I would suggest discuss with your lawyer and take calculated risk.

For the safer side i would send affidaviate of your parents (2) and from third person who is/will not benefit from your immigration and send to ins in addtion to your copy of your orginal bc.

The only catch is that you are sending a copy of a document to BCIS for which you do not have the original.
