OR approved at CSC

Folks,
My OR petition (filed Feb 2004) at the CSC has been approved without an RFE. Thanks to this forum for all the help, information and support. Good luck to all, and happy holidays!

Congratulations!

Could you please share more of your information? For example, Are you in Company or University? How many pubilications and reference letters? Are the reference letters from the people who do not know you? Any award? Any review of other's work? What do you think is very important for your I-140 approval?

Work in a medium sized chip company (3 years). PhD, with 12 publications in top conferences/journals (engineering), 12 reference letters, majority from people who I haven't worked with, but who i know through conferences/research reviews. It is important to get letters from outside the country. I got 1 from Canada, 1 from Japan, 1 from Hong Kong, and 1 from Taiwan. It is important to have very focussed letters that comment on your specific abilities that make you an OR, and to discuss your prior research work and how that work influences the works of peers.

I am actively involved in research reviews, and frequently review conference/journal papers. I am also on the PhD committee of a graduate student. My work was also mentioned in a reputed engineering news publication.

There is no substitute for collecting and crafting the best possible petition that you can. I used an RFE from another petition (which I obtained through my company immigration lawyer), and used that as a model of what to do right, and what to avoid. It has become tough to get through the OR, esp when you are in the high-tech area, and with the narrow interpretation that USCIS has of Outstanding Researchers. I was actually discouraged from filing this petition by my company (i persuaded them anyway), but I went and did the best I could, and got through without an RFE.

I am not sure what you mean by "anyone can write the letter". Obviously, the person writing the letter must be an internationally recognized expert in the broad field you are working in, and should be able to comment (as an expert) on the critical nature of your research.

Of course, if you are in high-tech, you do not want a person with a background in biology to write you a letter. The first few paragraphs in the letter are devoted to how the letter writer qualifies as an international expert in the broad field in which you are working, and how he/she knows you (through your papers, or through meetings at conferences etc).

Does it mean I-140 and I-485?

I140 OR got approved yesterday at CSC!

Finally, it is my turn to bring you some good news. My I140 OR was approved yesterday from CSC, no RFE.

The University submitted my I140 OR petition to CSC on Nov. 7, 2003. My basic information is following:

Research Scientist in University. ph.D. in chemistry. 12 publications on English Journals(9 of them is the first author). Several conferance papers. 1 charper of a book. 7 Recommndation letters from China, Canada, and America. Member of several scientific societies. Total about 100 citations of my work. No big awards except some gratudate student awards. Never review other's paper.

hang on there, you will also get yours approved.

Did you even inquiry ? What about 485s?
 
The officer in our University did an inquiry for me on January 12, 2005. The second day, I got it approved. I don't know what is the exact relationship between the inquiry and the approval.

My I-485 was submitted on late April of 2004, which is later than the date of I140 submitting. It is still pending.

Which university you work in ? And do you know how did your school officer make the inquiry? like what number he used ...
