Options for Getting Green Card - URGENT

Hello,

I am in USA since last 2 years on H-1B visa. My husband is a Green Card Holder since 3 years 7 months. We just got married 2 months ago. What are the possibilities to get my Green Card?

- Since I am already in USA, does that help in getting a quick visa number through I-130?

- Can I file for I-130 and 485 together?

- How long is it taking to get Green Card through this process? My husband is in CA and I am in Atlanta?

- When can my husband apply for Citizenship? How long is the process taking in Orange County, CA?

- If we take the citizenship route, how long is it taking these days to get the Green Card after my husband's citizenship is approved?

- What are our other options?

- Is there any new legeslation pending in Senate or any new Bills that if approved can help people in our situation? Can you name some of them and direct me to a website or link where such information is available?

Thank You for your help. Since I am on H-1B, I cannot move to CA to be with my husband until I find a job there. We have been in stressful situation because of traveling and I am really looking for some advise and direction from gurus to see what we can do?

Hello, I would like to add 2 more questions.

Do I really need to apply for I-130? Cant I just straight apply for 485 since I already am in USA?

Can I file for I-864(affidavit of support by gc holder for spouse) and I-824 for consular processing and see if the process is faster? How long is that taking these days? Can anyone throw some light or any experience?

Just to add to the answer, after your husband get his USC, it will usually take 3 months to a year to get your GC. Some area of CA can process GC application for USC within 3 months.

As hard as it maybe, both of you are in better situation than most who are in illegal status (or in between status) and can not do anything in US like work and travel. I think 3 years time frame is about how long it will take you to get a GC via the petition from an USC.

Thanks for sharing the information. Basically that means that we are fucked. My wife is in Atlanta and I am in CA. We dont know what to do. I cannot change job and she cannot also unless someone sponsors her. Seems life is going to be in the plane.

I can understand your frustration. Many are in the same shoes or worse. At least both of you are not too far. I was separated from my wife for two years. She was oversea, so I can only see her once or twice a year.

I afraid there is no other options better than what you are in. Make the best of this worse situation. :-)
