OPT to H1B - URGENT Advice Needed

Hi Friends,

I am in a visa predicament and could really use some advice from you guys.

I completed my Masters degre ein dec 2012 and my opt began on 1st feb 2013.
I was placed in a company 'A' but my employer delayed the joining date from feb 2013 to aug 2013. Since i had to maintain my visa status and also for financial reasons i took up another job at company 'B' which i started only yesterday.

I however plan to quit company B in july and join company A as A is my dream company. Now company A has offered to file my H1B visa in april 2013 even though i will be joining in August 2013 only.

Can i continue working at company B till july even though A will file my H1B in April. I have heard that the H1B status will be valid only after october 2013 . I am currently working on my opt. Please advise. This form has been immensely useful so far.
 
You can work with company B for as long as your OPT is valid. Once your H1B is approved, you can begin working with company A. Since you come under quota your H1 employment can begin only from October (which is the begining of US government fiscal year).

Thank you for the reply. I had another question. I can also ask company A to not file the H1B in 2013 and then work on OPT and later take the 17 month stem extension (A is e-verified and my degree is under stem). Would you recommend working on (opt + stem) and getting my H1B in 2014/2015 or shifting to H1b right away ?
 
That is your personal call but I think working on OPT saves you some Social Security taxes, please check with IRS/tax consultant. Other than that, there should be no difference between working on H1B and OPT. Does taking 17 month STEM extension require additional paperwork on your part?
 
L1 to H1

Hi,

I am here in US since 2010 on L1 status on company A. My L1 is getting expired on 30th Aug 2013. If company B, sponser's me H1 in this FY(2013). Following are my questions/doubts,

1. If my new H1 gets approved before Aug, Does new H1 overrides L1 status, and can i move to company B ?
2. If not, how can i maintain the status till Oct 2013 ?
