OPT to H1 during the 60 days grace period ...

Hi..
I completed my Graduate studies from US and my OPT expired on Jan 31,
2005. My 60 days grace period expire on April 1,2005 (April 1 as 60th day).
A consultant has been ready to file my H1(work visa) under the delayed 20000 additional quota.

My question is:

- Currently, the date to file the H1 under the 20000 quota has been delayed. Supposedly, the USCIS declares April 1(also my last day of 60 days grace period) as the filing date for that 20000 H1 quota, would I be in status if the consultant sends/files the H1 papers?? When can I start working if the visa gets approved under this quota?

- Assuming I file on April 1, 2005 for the regular H1 quota of 65000 visas to open in October 2005, would I get to stay on a valid status till I get to start working through the consultant from October 1, 2005 which is the actual starting date?? (Please answer to the above as: What if my visa GETS approved and What if my visa DOES NOT GET approved).

Your response will be greatly appreciated..
 
I am not sure but I think once your visa gets approved and if you are not under OPT or any other related status you will have to leave the country... i think you will be out of status when the process is finished... you should check with a lawyer though...
