We have an individual that was on an OPT that will expire the end of June, which was not fortunate enough to be selected in the lottery. We are looking at alternative options for possible employment in the future with him. He has been accepted to a local Univerisity and will start there in the Fall. We are aware that he will likely be unable to work and will have to sustain himself during that period, though he is speaking with the University about options. We are looking at the possibility of sponsering him for a Green Card and are wondering if we have petition approved for him can we file automatically for the EAD and have him start working with an approved petition or do we need what until the Perm Application is in process? At what point could he start employment? We will also try and file for another H-1B for him in the Spring but as with this year, it is no garantee. He is also from Nepal and only has his undergraduate degree so we are looking at a almost 2 year backlog already for him to receive his Green Card. Any ideas or suggestions?
