OPT to Green Card or OPT to H1B

Hello,
I'm currently working on 17 month opt extension and my opt ends on Dec 2014.

I'm planning to apply for H1B next year so that i'll have H1B before my opt expires.My company is willing to sponsor H1b and Green card.

Following are the couple of questions that i have:

1.Now my question is that can i apply for Green Card in Jan 2014 and than apply for H1B in April 2014 side by side?

I want to do this because i'm worried that i'll have to leave my job once my opt expires and i didnt get H1B. And also because i have only 1 shot of getting H1B before my opt expires as my opt ends on dec 2014 and even with the grace period of 60days it will be valid only till Feb 2015 and thus i'll not be able to apply for H1B in 2015 again.


2.Suppose i only apply for H1B in 2014 and if it gets rejected than can i apply for Green card at the start of 2015 when i'll be on my 60days grace period as my opt will be expired by that time?

3.Is it a good idea to apply for green card and H1B at the same time?

4.Is it a good idea to apply for green card when H1B gets rejected?

I know that i can always join the college once my opt expires and can apply for H1B once the window opens but i'm looking for the option which dont involve going back to college for short time.

How to apply for us work permit as spouse my husband got a job in usa

I was just wandering what to do as my husband got a job and all the visa formalities are done by the employer as i wanted to accompany him and also
work whilst I am there and wandering what steps needed to be taken prior to my arrival in states and also if usa rules are similar to Canadian Immigration ..also Me and my husband are Canadian Citizens...or if i would get an open work permit as per my husbands work permit and status validaty any input will be greatly appreciated.

If you are from non-retrogressed country and employment based category of classification is current, you can go green card processing. After your labor certification is approved, you can go simultaneously for step 2 and 3 (I-140 & 485)
 
OPT STEM to H1B

Hello all,

I am on OPT STEM extension until feb14, 2014. I got laid off by my current employer on 31st Dec...leaving me only 30 days on my OPT STEM period to stay unemployed that ends Jan 30th. I have not found any other employment yet.
My 60 grace period ends on April 14th, 2014. My F1 visa expires end of July'14.

I am planning to get my H1B filed this April through a consultant. Hoping that my H1 gets approved through them.
So far, I have been told that I can continue residing in the country until my H1 status is pending but I am not authorized to work. I can only start working Oct'14 once my approved H1 gets activated.

My questions are as follows:
1. Can I continue to stay within the country without violating any immigration status laws between 30th Jan-April 14th period and April 1st to Oct 1st in case H1 is filed & employed or H1 filed & not employed?
2. Am I eligible for cap-gap?
3. Can I file for multiple H1s?
4. In the event that my H1 is denied or my application doesn’t get selected in lottery..Do I have to leave the country immediately or do I have any options left?

I would appreciate any help and feedback !!
