Hi

I am a student on F1 and I have applied for my OPT. My case is still pending and I think I will be getting an offer for a job before I get my OPT approval. I have received LIN Number from BCIS.

Is there any way I can work if I get a job with this LIN Number as in the case of H1?

If not then what is the best way?

I dont want to loose the opportunity I am getting.
Please advice me and thank you for your time.

No you can't work before your OPT is approved. Has it been 90 days since you applied your OPT.
Because if it has been 90 days since you applied your OPT and haven't got any decision then you can go to your local INS office and get a temporary OPT.

If it hasn't been 90 days since you applied then you can try the following:
1. Ask them to wait. If they can't then go to # 2.

2.You can request the company to let you work for free till you get your OPT/Temp OPT, kind of a voluntary service. If they want they can pay you for that after your OPT is approved. But who cares about this small money if you have a job in this economy.

3. I would suggest not to tell about all these things because they offer you. Tell them after they decide to hire you, because this can jepordise your chances of getting selected.

I think its not 90 days and much less than that. Is there any form or application to speedup the process. If so please let me know..

Krishna, I understand your postion, but I don't think such letter would help you in any way.

Its not just you who has a case like this, there will be thousands other, who will be in same situation. If INS/USCIS starts giving consessions then people will stand in line in front of their office and and give them emotional reasons and get their cases approved. I am sorry to say this but I am telling you the fact. In my opinion such letter won't help you in any way. (Its my personal opinion)

I heard somewhere that before your EAD is approved you are not eligible to accept any job offer, legally. Technically you shouldn't be accepting the offer before your EAD is approved. But who cares, its not a big deal. You can definately go ahead and accept the offer.

Your best bet would be to get consession from your petential employer.
 
Hi Krishna,
Here is one more option.

Start the job as it is.Also tell that your OPT was approved and everything is fine.

Once you start it will take atleast 30 days to process u r pay stub.

before this is done tell them that your OPT card has been mailed to a wrong address and will be mailed to you soon, and ask them to wait untill you receive the card.
