i have a gap between my opt end date and H1b start date (around 2 months). my H1B has been approved with a start date of oct 1, 2006. in order to stay in status for the gap period, i enrolled for a master's program starting from last week of august. since my H1B has been approved, do i have to take classes and be a full time student till October 1 or can I not take classes (I won't be a full time student during august and september). will this affect my legal status? will this cause any problem while stamping?

Thanks!!

OPT/H1B gap

Have you heard about the 60-day grace period? My lawyer told me I have 60 days after my OPT expires to just hang without traveling and working and still be legal. Good luck!

Yes, my end date included the 60 day grace period (the period when I can't work). USCIS approved me since I was able to provide a new I20 from my new school to show that I was in status during the gap period but now I have to decide whether to take classes for one quarter before joining my new company (which sponsered the H1B visa) or not. i will have to spend a lot of money from my pocket if i take classes.

oh, I see. You know, I would probably go ahead and take 12 credits to be a full time to stay on the safe side. As far as I understand, if you don't take 12 credits while on F-1, you are not legal.

What if you will be applying for a green card later on? These lousy couple of months might affect your application negatively.
