OPT Extension Question

Hi Guys,

I am working for a company and they have applied my H1 also. I am awaiting to see if i will be selected for the H1 or not. I have some questions please try to response me as quickly as you can. I really appreciate all the help.

Degree: Bachelors COmputer Science(May 2007 Graduated)

1) My OPT expires on 2nd May 2008. My company has filed for my H1. Can i take advantage of the 17th month grace period extension? the company i am working for is registered in E-Verify Program.

2) Say for instance God Forbids if i get rejected for my H1. Can i still continue to work with that OPT Extension for the same company? and then i can apply it next year again?

Please i would like to go to USCIS today so if i can get teh answers that will be very great.

i have a similar question

I just got a new job at an MNC in their HR dept. We have hired 3 new people last week, One Taiwanese, One German, One Indian with a Masters on an OPT. OPT expiring in Mid June 2008 and H1B starting in Oct 1 2008.

All three got their H1B approved (two transfers, one New H1B for the Indian student).

The Indian student has come to me with these questions, I have directed her to the company lawyer...but the new rules has the lawyer confused too

Her two questions are as following

1) If she applies for automatic OPT extension WITH change of Status within the next 30 days. Can/will she be able to travel to India and go to US consulate to get H1B visa stamp before October 1st 2008?
2) When does the change of Status become effective?? Is it immediately, or Is it in Mid June when OPT expires, or Is it on October 1st 2008?
