OPT expiring... Please advise!

Hi all,

I graduated from college last August (2006). Now I am working full time with an OPT.

It's 6/17 today, and my OPT is expiring on 7/31. H1-B has been filed. But since there are so many people are applying this year, I still haven't heard from the lawyer about the result. And there's nothing I can do about it right now, since the lawyer said I could only wait for the result to come out.

At this point, I have a couple questions.

Firstly, if I apply for 2007 fall MBA right now. Do I need to go back to my home country (China) during the GAP (7/31 - Sep)?

Secondly, if I can get in school this fall, do I need to go back to my home country to get the other F1 visa, or I can get the new F1 visa in USA?

Thirdly, if I get the H1-B, do I need to go back to my home country to switch from my current F1 to H1?

Fouthly, after my OPT expired, can I take some classes in some school, which can sponsor F1 visa, in order to avoid leaving the U.S.?

If you remain F-1 and register for the Master's Program, you will receive a new I-20...therefore, you will not have to leave the US (you'll be in status). However, if you leave the country, you will have to apply for the visa stamp abroad as an F-1 student. If you change your status to H-1 once it is approved, and you leave the US, you will have to apply for a visa abroad. However, since your OPT is expiring during the summer, and the H-1 will only be available from OCT 2008, ask your lawyer about remaining in the USA during that gap. I am not sure what happens then. Is there anyway you can upgrade to premium processing (extra $1000). Good luck. By the way, consult with your lawyer either way...and perhaps your school's international student office may be able to help as well...
 
I've already paid for the premium processing. But since so many people are applying, it got delayed and delayed. I still haven't heard any result yet.
 
I talked to my boss today about green-card sponsorship. He said he would apply for me if it suits. Any advice about switching from Green Card will be highed appreciated. Thanks in advance.
