OPT expires before new H1B quota for 2005

Hi,

I am currently on a F1 status pursuing my OPT. My 12 months OPT ends in Sep'04. My employer is willing to file H1 for me but H1B quota for 2004 is over.

So what all options I have now?

1. If my employer files H1B under 2005 quota, can I stay in US after my OPT period is over?

2. Can my employer file for a labor certification before filling H1B and can I stay in that case?

Any advice would be greatly appreciated.

hello guys,

Like some others here, my OPT expires before Oct 2003, and i dont know whether i may be allowed to stay in the country after that or not, even if the H1B visa application has been filed by my employer.
