OPT expired before H1b approve

Hi,

My practical training will be expired in 10 days, my h1b was filed in June 19, according to the real processing time for Nebraska center, it needs three months to process h1b application. What will be my status after my opt expired and before h1b approved? Can I continue to work? I will be very appreciated it if somebody can give me some information.

After your OPT expires you have a grace period of 60 days for which you can stay in the country (if do not file for change of status). In your case, since you have filed for change of status, you can stay as long as your petitiion for change of status to H1 is pending. However, after your OPT expires, you cannot work until your H1 is approved. Another option is to go for premium processing which is processed within 15 days.
