Opinions reqd EAD/AP

Hi,

ND 10/22/99 FP 3/9/01. I never recvd my I485 receipt..was told lost in the mail. I\'m on H1 and am planning to go to India around the end of May.My company is advising me to get AP and apply for EAD. I\'m wondering if its reqd. Do you guys think I\'ll get my approval before I leaving making EAD/AP moot?

Chances are slim that your I-485 will be approved before your trip.

Lawyers generally advise that you carry your I-485 receipt even if you are travelling on H-1. However you are not legally bound to do so. As long as you have a valid H-1 stamped in your passport and have not used any EAD, you should be OK.

I would recommend foregoing EAD/AP especially if you have to pay for the associated legal fee yourself. If company is paying for that, you have an open choice. See www.immitracker.com for pros and cons of each.
