Opinion on Schedule A / NIW

Dear Experienced Members

I want your input on success of my Schedule A (Exceptional Ability) application ( similar criterias as NIW)

I have US doctorate. Work expereince of over 12 yrs in India at University. Several confrence papers in India, canada and US two indian and one US prublications in journals. getting 8-10 letters from US Academic, Industry experts, Not any major citations of research, Currently working at US university as teaching faculty so application will go through university.Getting one letter from India. hired a lawayer. Work in area of agriculture, environment and health.

Based on your recent experiences can you let me know how much are the cahnces of success of my case for EXCEPTIONAL ABILITY ( Schedule A Cateogrey II) filing . Schedule A and NIW has mostly same requirements.

I think you have a chance there based on the fact that two of my techs who are from india and have only US masters and no papers got thru in this category recently.

you can just apply 140 to see what happens after all 485 is open in this category and is expected to remain open for any national in the future. hence if approved you can immediately file for 485.

when preparing just treat it as a NIW. only difference is that Sch A exceptional ability is not a petition filed by individual but by an intitution so your employer needs to file it and all the letters must address that fact.

thanks for your response and input.

In fact I am interested in concurrent filing because, I got news that this categorey will also retrogate some time in first quarter of coming financial year (approx. Sept/oct-06). So I dont want to take chance with that. Let me know if you have any more input knowledge about that.

Also when did your friends applied and when did that got approved, that will get me some idea of processing speed in these cases.

it took them two weeks to get approved. and they got green card total within three months. I am their boss and I got approved in EB1 yet I dont yet have green card in 18 months.

but I am happy for them and thank our lawyer who suggested this route to escape retrogression. I will also be happy if you can get it this way. best of luck.

I need some more info as my lawyer say she had submitted her first cases in last november or so, but havent got any thing approved yet. So wonder when your friends cases were submitted. If you dont mind can you email me your lawyers info.

which service center they got approval in 2 weeks, which service center they have not heard since Nov, it may not depend on lawyer, but service center processing times,
I applied Sch A recently at NSC, will update if i hear
 
I am gathering all the papers to apply in Sch A. My lawyer has never done this, and is not very responsive. I'd love to hear any experiences.

Who filed Schedule A Cat II recently from TSC or NSC can you update your status for Processing Of I-140 and I-485.
