Opinion on NIW case

On a NIW case for members of professions holding advanced degrees.

Does anybody know what the difference would be if it is a self-petition or a University signs as petitioner? Would it help?
Thanks

self-petition is better

because you are not restricted for the employer for even the 180 days. your employer has no control over the 140 also. so like some employers revoke 140 (even after 180 days of I-485) and cause unnecessary headache, it wont be a bother at all for the self-petitioned cases.

What if the possibility of getting lay-off wouldn't be a big of a threat. Would the USCIS give more attention or weight to the fact that the University is the one signing the petition?.

NIW and EB1-1 (Exceptional Ability) is a self petition route where you don't need an employer to sponsor you.

If you have a university willing to sponsor, EB1-2 (Outstanding Researcher) stands a better chance of success for sure.

It all depends on how qualified you are for the self petition categories ...

My petition for NIW is under Section 203(b)(2), as a member of professions with advanced degree or Exceptional ability, and yes, there is a University willing to sign the petition. So do you think I have a better chance if the university is the petitioner?

Why do you think that the fact the university signs off will somehow benefit the American people more than if they did not? If you can come up with a good answer, then the answer to your question is yes.

Frankly, I think that unless there is some reason why NIW is better for your particular case, your school probably should gone EB-1 OR.

how about 2 copies of I-140 for NIW, One is self-petition, the other is employer-sponser.

would they be regarded as duplicated filing or two separated petition.

please comment.

Thanks
