opening a company with H1???

Hi all,
Would appreciate some advice from the gurus - i am currently on an H1b and want to quit my job and start a company
whats the best way of doing that? can i legally do one of the following: (i dont know too much about the immigration process)
1. Get a partner (US citizen) to incorporate a company and then get him to sponsor my visa. However, If i own say 50% of the company, can he still file for an H1 and green card for me ( i saw somewhere on this forum that you cant have more than 5% stake if a company is sponsoring your GC)
2. Get a company which hires out contractors to sponsor my H1 and work on my company as a contract job and incorporate the company once this contracting company has done my GC?
3. Change my visa to something else?

What are the restrictions on these options - any tips would be appreciated

No , i have no intention of circumventing the laws. I dont know the laws , so i was clarifying what they are.
I did not know that for a gc, you have to have intent to work for the company sponsoring it,- its seems strange specially given the hire and fire policy here, no job is gaurenteed- so it looks like even with a gc, legally you are bound to an employer- correct?
One last clarificaiton- if i am working for a company as a contractor and they are paying me, should i ensure a minimum pay to make sure my H1 transfer doesnt get rejected. What are the rules around that?
