Opening a company while on H1B visa

Hi All,


Is it possible to open a company either a LLC or an INC while holding a H1B Visa? If yes, what is the procedure? I read in a couple of sites that one cannot work for their company and draw salary while on H1B Visa and require person who has permanent work permit (GC/US Citizen). Is this a general procedure or is there a way out?

I believe that you can open a company, but you cannot "work" for that company on H1B. In other words, you cannot employ yourself on H1B.

---- Yes. Open a company and then apply for either a full-time or a simultaneous H-1 for your own company. There are a few conditions applicable. First, you must be working in your own area of expertise. For example,a Scientist may NOT open a company selling cosmetics. Second,
technically, your company must pay your wages even if the company is
not making any money. All other regulations applicable to H1 remain the same

If I am understanding correctly,

(1) I can work for the previous company and still own a company under my name?
(2) I am not interested to transfer my H1B to my new company, but can I still work for it?
(3) I heard from friends that you need permanent work permit holders like GC or US Citizen to do all the work for the company and I can only be an investor?
