Foreign workers sue to force status rulings
By Jessie Mangaliman
Mercury News

A group of high-tech foreign workers from across the country has filed a class-action lawsuit against the Department of Homeland Security, the federal agency that oversees the country's immigration system.

The lawsuit was filed last month in U.S. District Court in Washington, D.C., by nine immigrants and ImmigrationPortal.com, an online immigration discussion group, saying many foreign workers have been waiting years for a government decision on their green card applications to stay permanently in the United States.

The suit names as defendants, among others, Homeland Security Secretary Tom Ridge, the chiefs of three immigration-related agencies under his supervision, the directors of immigration service centers and U.S. Attorney General John Ashcroft.

This has a date of Jan 2004 and yes inspite of it being ongoing , the retrogression has been imposed so what do you think ? how useful is this thread ?

If the lawsuit hasn't been judged or came to a conclusion, it could not stop the cut-off dates or have much positive impact on it. Lawsuits usually take years to bring benefits, therefore this thread is important and if more people could join that would be a good idea.

Let's sue them

Who cares any more...Let's sue them...they need to be taken to the court for taking our tax dolars and sitting on their butts doing nothing...

Excellent Idea - And a possible EB Retro FIX.

I agree with some of you that Lawsuit may be a fitting answer to the EB Retro problem.

I do not want to discourage the hopes of folks who have put a lot off efforts to get the attention of the mandarins. I strongly - support the move for Class A law suit for taking the engineers for a ride with the hope of getting GCs and eventually the folks leave back SS Tax for which they are not eligible to get due to their nationality.

Once the lawsuit gets enough publicity and media attention, the GOVT will positively use a backdoor method to clear the existing problem. But it may cost the new H1s of not getting the benefit of being eligible to get the GC.

I have contributed a decent amount to Immi Voice, I do not mind chipping in couple of hundered if they can atleast get our Social Security Tax money to our accounts into the country we would go back to :-) - Say Provident Fund - India, or CPF if Singapore. I strongly think this is worth the effort. At least you stand to get 50,000 Dollars or so. Even if you did not get the GC, you atleast get back your own hard earned money which can be useful for your future investments.
