Hello All,

I got my I-140 approved with company A recently. Now, I want to join company B.
Question: Is there any way I can join company B and file for my I-485 on the basis of approved I-140 from A ? Can I carry the approved labor and I-140 to company B ? Is it allowed ?

Or do I have to restart the GC process again like filing for the labor from company B, then I-140 and then I-485 ?

Please help.

The LC is employer specific. Are you subject to the visa number retrogression and is unable to file I-485?

Yes you can carry over Priority Date from previous approved I-140. You will need a copy of approved I-140 from previous company. You can not carry approved labor so you would need to file a PERM from new employer then able to file a new I140 along with old approved I140 to port old PD.

For 485 your old priority date needs to be current for filing 485.
