I received an RFE on (5/2/2006) on my I-130 case filed in 2001
....It asks for a passport size photo of me and my husband and the biographic information (form G-325A).
But when my husband had filed the petition i didnot have a visa so he did answer (NO) that i had never visited the US and hence he would have filled out the address for consular processing....so my question is since i am here in the US......hence my present address would be here when we fill out the G-325A form....would that be a problem..Would they deny my I-130 on the basis of this?
since we are only now filing this G-325A forms. He didnt know he had to file it aswell...I am a bit worried right now? I was hoping that his citizenship would have come through by now..since i read here that spouse of a citizen's overstaying is forgiven!!
For those of u who dont know my case let me share it.....
Came here on a b2/b1 visa in 2004 valid for 1 yr...went back home after 6mths...came back after 2mths and hvnt left since.....husband is an LPR (has been for 20yrs) finally applied for citizenship in Feb of 2005....anyways he finally had his interview in Jan 2006 (USCIS fault - sent to wrong address at first) passed his interview ....still waiting for oath letter....office said he wld have received it in the mail in 2 to 3 mths.....hvnt gotten anything....we are in Dallas....he has an inforpass on 5/16...
