On What basis i can file for 7th year extension?

1) I am aware of law that if your LC application is pending for more than one year u can file for 7th year extension . But since as per new PERM process LC gets approved within 60 days . What r basis for filing 7 year extension now.

2) I have accumalated approximately 3 months of vacation time which i spend out of country during my 6 years term of H1b visa. How can i reclaim that time on visa?

Have you applied any labor already! or Are you going to apply in PERM soon!
If you are going to apply only through PERM and if your visa 6 years expires within a year of PERM approved or applied, I think it is a problem. why don't you try a subs.labor and apply I 140. So that you can use that for your 7th year extension.

if the labour approved and filed for I-140 then u can use I-140 receipt number to apply for the seventh year extension.

we also have more than 3 and half months of vacation time. but we didn't include while h1 extension is applied. we are on h1 7 th year extension. we also applied using I-140 receipt number. INS won't consider the less than one month vacations. so if u are on vacation for more than 30 days are so continuously. then they will count that. any way i am not sure about that.

I am not sure about your explanation to get 7th year extension by I 140. Even in that case there should be at least a year time from LC applied date. I think it will be a problem if he applies PERM and can use that for 7th year extension
