I have some questions, can you please share your experiences on below items?
On PERM process - unique situation:
1. My employer has applied (Online) EB3 & EB2 in PERM process looks like EB3 went first and is accepted/approved(looks like one can't apply in both for same alien and job request) and EB2 got denied at first step only, as per above timimg and multiple case submits issue.
a. Now, is that my employer can reapply for me in EB2 on PERM
(as this might speed the GC process, as per my re-request)?
b. Is that earlier EB3 case need to be withdrawn for reapply to EB2?
c. Is that denial letter on EB2 can be further proceeded with re-request
with BCIS, by making my earlier EB3 case withdrawn?
2. I know its an tough and complicated Question- which one would be
good in present scenerios whether EB2 or EB3 (if they apply now)?
(looks like lots of apps were filed in EB2 compared to EB3 and also %
availabilty will be less for EB2)
Any information would be greatly appreciated.
