On opt h1 b approved / laid off/ withdrawal notice sent/another offer now help/advice

Hey John,

I have read a couple of your replies and you seem very knowledgeable about the H1B visa process.

I am in some deep situation and need your advice.

Here goes, in short i am an intl student with his Masters from a UT Texas. Masters in IT Dec 2007 graduate.
Opt valid from Jan 14 2008 to Jan 13 2009

Started working on OPT for Emp1 who sponsored visa H1B April 2008 and was approved.

Emp1 laid me off on May and I moved to Emp2 immediately. Emp2 hired an attorney and she took the reciept number from Emp1 and transferred it to Emp2.

Bad luck struck me and Emp2 incurred losses and laid off again on July 15th. Emp2 informed that they are obligated to withdraw H1B. Found out that Withdrawals usually take a few months to actually apply and I can find Emp3 to transfer similar to how Emp2 did from Emp1.

Found Emp3 today, a medical university/hospital, they are cap exempt and can apply, sponsor any time is what their dept told me. They want me to start off on OPT and then the dept will sign off the request to sponsor my H1B and then they would is what they said. They said they have no policy of transfer and it will be a fresh application (which didnt make sense to me)

My question is my online status with the receipt number from the Emp2 transfer shows approval notice sent. It does not show withdrawal notice sent. So on Oct 1st will my opt automatically cancelled, because technically my H1B isnt withdrawan yet coz if it were then the status should change.

Can I extend my OPT ? And also its an IT job in a cap exempt medical university so do I have to worry about that ? Would I be cap exempt too ?
