On calling IIO.............

Just for your info:
Called Customer Service Rep this morning and was transfered to another person (Not IIO), a lady picked up.
My question was:
1. I am into 28th month of filing 485, Did not receive 2nd FP so far?
2. Almost 8 months since 1st FP expired
Took my details and was on hold for 5 minutes.
She came back and said it is taking between 30-32 months to process this kind of case. Also explained me about 2nd FP procedure. I have to wait for another 4 months, I guess. Thats what I interprete from this.
She explained regarding 2nd FP. What I understood is that if RFE has been issued and received by them and so far no 2nd FP, that means RFE has not been cleared. If a person receives 2nd FP after receiving RFE, that means RFE is cleared and good to go.
So if someone is expecting 2nd FP and there is no response after RFE (atleast one month has passed after RFE notice date), then:
a. More chances of getting transfered
b. More undue delays
c. Approved without 2nd FP (Rare/Impossible)

Not sure about this one, I think there were people that were approved and then FP-ed after the fact. So, it might be rare, but maybe not as rare as you think. Another question, did you or her imply that 27 months (15 months + 1 year) is what it takes to raise a red flag on FP expirations? Also, 30-32 months for what, an I-485 in general.
 
Sorry to hear about your status enquiry. It's scary news for us (that the processing time will be 32 months and it takes another 4 months for 2nd FP). We have to fight this type of attitude from VSC. Please join our fight by contributing online. Let me know if you have any questions about the organization .

yes, 30-32 months from 485 RD.

I have not seen any 485 approval without 2nd FP.
Correct me if Iam wrong.
 
Well, this was exactly the reason I stopped calling NCSC and took the matter up through the Senator's office. It was only when I went through them that I came to know that our Name/DoB check and FP review was complete waiting for clerical action. It's another thing that they issued an RFE (Emp Ltr + 2 month's pay stubs) but I feel if we hadn't contacted the Senator we'd just be waiting endlessly without accurate information from NCSC. At least now we feel that our case is moving ahead. I think you should wait for another month or so and then contact your local Senator/Congressman. I feel that your case will be approved in a week or two given that you submitted your RFE response on April 6, 2004.
 
What if a person receives just FP2 and no RFE. Is he good to go, meaning no RFEs will be generated?

I can contact my Senator only after 6th June 2004. Last when I contacted, their office said to contact only after 60 days.
Hope to receive something after that. Atleast 2nd FP hopefully.

Possible, only if your processing date is current. Not before that.
In your case when the procesing date is updated to 29th August 2002 or more, U could expect approval without RFE if your 2nd FP is done.

What do you do when you contact your senator ? I want to
do the same. My 485 was filed in Oct 2002 (not concurrent).

By what means do I contact them ? Phone ? Email ? Fax ?
Whom do I ask for ? And what do I say ?

Also, my service center is CSC. I believe contacting the senator
should still help, right ?
