Old I-94 expired and No New I-94 with H1

Hi,

My old I-94 expired in May 2002. I got a NEW H-1B (not extension or transfer) valid till Feb 2004. But I didnt get a new I-94 with the H-1B. I have not traveled out of US since 2000 and did not revalidate my Visa stamping on my Passport.

I am planning to return by March 2003. Will there be any issues in travelling because I have an expired I-94 card,(no New I-94),even though I have a valid H-1B.

Please clarify!

I got same problem. Could ypou please give me a advise what to do in this situation. I got expired my I-94 and Visa on Feb 2003 and approved my H1B without extension on same day. My company had applied for Review the petition and got receipt for that. I have question that :
1. What is my status now and Is it advisable to go India and get it stamped ?
2. Is there any problem while coming to US since my extended stay without I-94 for 2 months(I have a receipt of INS that we opened Motion to Reopen.

I really appreciate if you give me some advises on this. Thanks in advance.

here goes...

Late_lateef : you are illegally in the USA since May 2002 and since the INS has issued you with a H1 with no I-94 they know. You already qualify for a 3 yrs ban in the USA..if you stay on for 1 more month it will be a 10 yr ban..get hold of a really damn good attorney, but I think it will be tough...please take this seriously!!!

bobkris: you too have been illegal in the USA since 2 months, but you are still not in deep trouble..get out of the country and get yourself a new visa and re-enter ASAP.

If any of you have plans on getting a green card in the future..you are seriously putting that plan in jeopardy.

Thanks for response. How come it is illegal since I have a INS receipt that my case of Motion to Reopen is in pending.
Is it a problem to get stamping (wonder if consulate people asks me why to stay after even expired my I-94) ?

I too need an advice in similar case with little difference.

i applied for h-4 extension along with my spouse h-1 extension in may 2002.i got the extension resently in march.but both i-94 and i539 are valid from mar 2003.i-539 clearly states that application was received in may 2002.
how it will affect this in my future,espcially in regards to my h-4 to h-1 conversion.
