Hi,

I've old I-94 valid until Aug 2005 and a new I-94 (H1B extension) valid until March 2006. I'm planning to visit India in May '05. My question is, should I handover both I-94's or the only old I-94?

I believe I should keep new I-94 attached to I-797A form for future visa stamping purpose. Am I correct?

Thanks in advance.

If you read I797A it asks you to attach the attached I-94 to your passport, funny no one does that. To answer you question you need to handover both I-94's when you depart US. You should not have any I-94's with you when you leave the country.

Yes -- Sc3 is correct.

Staple both I-94s and hand it over. You'll probably want to keep copies of front&back of both the I-94s for your own records.

BTW, you'll see that the I-94 occupies only one half in the bottom of the approval notice -- the other half is to be retained by you.
