I had my H1B visa with Company A..who started my PERM Process and filed for my Labor ...Meanwhile I transfered my H1B to company B..
Now my old employer got my LABOR Approval and want to file for I-140
I have not started PERM PROCESS with new employer
- Questions i have is ? Can he really can file my I-140 since i left him 6 months ago...I don't have bad relation with him... but i have not intentions to back to him... .. i can if situation helps me
- As per him i can join him back after 1-140 will be approved or i can use the same I-140 (Priority date) with new employer if i want to stay with company B
- Not sure what are the pro's & con's of the situation ... But i am paying all the $$$$ involved with both employers ... I am confused ... anyway i have to file PERM with one or other ... but which will benefit me most ?? Not sure...
