Hi Gurus
I have a peculiar situation that I am listing below. please advise
1.> my wife (along with her parents) as a child had a green card when she was 4 years old
2.> later, her parents moved to india and returned only after 7 years.
3.> Automatically, their GC was considered abandoned. So in CHENNAI they applied for a new visitor visa
4.> now, we are planning to apply for I-485 based on my employer's Labor Certification.
5.> The lawyer said that my wife never formally gave up her green card by filling some I-407 form.
6.> can that be a problem ?? The lawyer sounded like it is some major problem
7.> is it wise to file the I-407 form along with the I-485 application (stating that she intends to formally give uyp her GC now that she's applying for a new one based on my LC/485) ??
