Hey all,

I am currently processing a green card for my wife who is Filipino. We've submitted the documents to the NVC. However, they (the NVC) are asking for my W2 from 2011. In the documents we originally submitted to them therein was a document stating I did not have a W2 for that year b/c I lived overseas. My employer did not provide one to me. Nonetheless, the NVC requested my 2011 W2 again after reviewing my documents the first time. Again, my lawyer and I submitted documentation stating I never received a W2 for that year. AGAIN, the NVC has requested my 2011 W2! Obviously, I cannot provide them what I do not have. My lawyer has suggested to get a transcript from the IRS for that year and submit that. My question is this: what happens if they again request a 2011 W2 after receiving the IRS transcript?
This situation truly boggles my mind and they're wasting my time.
Any advice would be greatly appreciated. Thank you!
 
Looks like you submitted a copy of your 2011 tax return, and not a tax transcript. If you submit a tax return they're going to want a 1099 or W2, but if you submit a tax transcript neither the 1099 or W2 is required.

This is from the I-864 instructions:
If you provide a photocopy of your tax return(s), you must include a copy of each and every FormW-2 and Form 1099 that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.
So the IRS tax transcript (the original as printed by the IRS) should stop them from asking for the W2 again.

I will go ahead and submit an IRS transcript of my 2011 taxes and of my account. One more question though. The document I submitted actually stated I didn't have W2s for the years 2008-2011 (I was employed overseas). I simply sent in my tax returns for all of those years. Why would they get hung up on the 2011 W2 and not the others?

The 2011 tax year is of primary importance, as it is the latest year for which you are required to have filed taxes (2012 returns aren't due yet), and the latest year you provided. I figure if you had already filed a 2012 return and submitted a copy of it, they'd probably be screaming for your 2012 W2 instead.
 
That makes...complete sense haha
Now, if only the NVC morons (and my lawyer) had just said that then I would've provided IRS transcripts in the first place!
