Obtaining an IEAD after 90 days with an RFE

hows everyone.

I have noticed three very recent posts in the EAD timeline thread in which applicants with RFE have been allowed to get an IEAD. Also when I was at my previous infopass appointment the Immigration officer told me to book an appointment for the 91st day. (I didnt argue)

My DO is Washington DC.

Im close to my 91st day well three weeks away. So I really hope this works out. Anyone with rfe and has managed to obtain an IEAD on the 91st day please reply to this thread.

Sent to Chicago lockbox
Then onto MSC
Day 01 Recv date 31st march 06
ND 5th april 06
Biometrics 4/19/06
RFE (1-485) letter dated 5/10/06 (I693 required)
RFE arrives at USCIS/NBC 5/25/06
RFE (I485) received (processed) by USCIS 5/26/06
LUD I-765 5/18/06 - no status yet
LUD I-485 6/03/06 – informed that I’m now waiting to receive their decision in the mail.
LUD I-130 5/18/06 – no status yet

Day 063 Infopass - 31st May 06 (Informed FBI background check fine!!)


Day 091 will be the 29th June 2006 :)

My wife is a USC and this is C9 APPLICATION
 
Just remember it is 91 days after they receive your RFE. So not from your ND for your EAD. Good luck

The Immigration officer at the Washington DO was very specific saying 91 days from my original app date I should book an appointment for IEAD.
She had previously just discussed my recieved RFE. I would try and get INFOPASS For your case on the 91st day. The worst case is they say no!! Best case you get it. For example a post from Fonzie on the EAD timeline. (page 34 or maybe 35, one of the most recent)

2/28/06 (00): 130, 485, 751 sent
3/01/06 (00): RD
3/07/06 (06): ND
3/09/06 (08): NOA, CK cashed
3/11/06 (10): LUD
4/10/06 (40): FP/Bio notice

4/17/06 (47): RFE sent
4/21/06 (51): RFE RD
4/27/06 (57): FP/Bio
5/30/06 (90): Interview notice {7/20/06}
5/31/06 (91): iEAD infopass (EAD approved) :confused:
6/03/06 (94): EAD LUD

I hope its really down to DO and not a national thing. I have found a few cases on this site where an applicant at DAY 91 (NOT 90 days after the RFE) get an IEAD. So they is hope for us all yet... PLease share your experiences on this thread....

Also I have noticed several cases without RFE dated 30th march 06 have recievd EAD approval emails. SO this is hope!!!!!

I have following timeline:

RD: march 16
ND: march20
RFE RD by INS: MAY19

I wanted to know that 91 days from RD or ND. I live in VA and the DO is washington DC and I am also thinking about going to the office and trying my luck on day 91.Thanx.

we are practically neighbours. You should go to the office I'm making myself an infopass appt for the 91st day.
Its worth a try.

The worst they will say is no.

Sounds like you're ready to start working! I have applied for WAAY too many EADs in the past 6 years (my visa is dependent on my husband's, and he was getting annoyingly short extensions from our university). I have always found they get it to me right around the 90 day mark - probably because they don't want to have to do an iEAD.
Also I am pretty sure you are correct on the ND vs RFE. They always lost my evidence that I submitted with my application (I swear they tore it up and sent me a RFE anyway, just to be contrary!). My experience is that they only stop the clock while waiting for your "evidence" (whatever that may be). So if it takes you 3 days to respond to them it is 90 days from your ND + 3 days - but I'd generally still get my EAD right around the 90 days. I think you should be fine with your 91st day appointment. And it does look like many people are getting there EAD before the 90 days (a first for USCIS!) so maybe it will come soon.

Little_brittain I made an infopass app. on 21st june,that was the only date available.If u have not made an app. yet do it as u can always cancel if u get ur EAD before that.I will keep u informed.Good luck

I'm planning on getting online after the weekend to book an appointment. The infopass system only lets you book about 14-18 days in advance.

I think I will get the EAD before the 29th June. Which is day 91. So I hope I dont have to trail down to Fairfax for the IEAD. But you never know.

Please keep me informed of any developments. Also I hope you get the white guy with the glasses (30s) and very clean cut (brown hair) seems very nice . I didnt get him... But he seemed very nice and was trying to help the customers out big time....

I will be counting down the days to your appointment I would be truly grateful if you contacted me and let me know if they did give u an IEAD.

I just got an approval e-mail for I-131.
I-765 was also touched though the messg didn't change so I am hoping that I would get an appoval for EAD pretty soon.Though I am keeping my app. for time being.
My husband likes the Argentina and Brazil team ,sorry I am not very fond of football.Goodluck with ur case.
 
Juno, so you got an LUD for I-765? I've seen on a lot of timelines here that an LUD for I-765 around day 70-80 means that you will get an approval email soon! Now, I don't wanna get you all excited, but it's a nice thought, isn't it! :)

I like Patty have been constantly scanning this forum. I think your recent update on your I765 on the USCIS website at this late stage in your applicaton is good news. I reckon you will recieving an email about the EAD b4 next. You may not to trail down to Fairfax for the IEAD.... Good luck and I hope you get it.

Your husband following Brazil is good choice (World Cup).

No ead yet ,so guess I will have to go to DO on 21st june.Want to know how long it took u from app. time to see an officer.My app. is at 8.15,it is about 20 mins drive from my place.Take care.

Hi Juno,

I reckon you mite get the approval EAD email before next wk.
If you live near the metro. Take the metro. The DO is right next to the metro station. If you do drive there park your car in the metro station car park and walk around the car park. Then walk about 3-4 mins down the street (prosperity ave) and there it is. You will be metal detected and possibly searched dont bring anyone who this doesnt concern or they will be asked to wait outside. BRING ALL YOUR LETTERS!!!!!!!!!!!!!!!!!!! BRING PASSPORT and BRING Infopass leter!!! (please dont give them a reason for them not to do their job) The wait varies I was in there for like an 1.5hr and my time with the lady was like 3-4 mins max. I hope you get the white guy with glasses brown hair in his thirties HE WAS VERY NICE!!! (I didnt get him)

So... I reckon you should get there early...

Got approval

HI litt brit,
I got may approval e-mail today(6/17),saying it was approved on 6/15 .I am so happy and Now I dont need to go for info pass.Hope u get it too before ur app.Goodluck.
