Oath Letter for my wife

I got my oath letter on Monday for Nov 19 at San Jose, CA. My wife has not yet received her oath letter despite both of us having interview on the same date.

We are getting a little concerned because we have bought tickets to go to India on Dec 26. We have a very tight timeline for applying for US passport and then Indian visa.

Would it help matters for her to take an Infopass appt to explain the circumstances and request Nov 19 oath? It would make our life complicated if she does not get oath letter for Nov 19, but gets pushed into December.

Timeline:

Mailed N-400 to Phoenix: 07/31/09
DO: San Jose, CA
PD: 08/03/09
FP: 09/08/09
Interview: 10/19/09
Oath Letter: Recieved on 11/02/09 for me, wife not yet received
Oath Date: 11/19/09 for me; Wife: ??

From what I have been reading on here, the fact that you havent received your wife's letter does not mean she will not get same date as yours. Moreso, there is plenty of time between now Nov 19th. Plus, there is plenty of time between now and your anticipated travel date. There are people who had a lot less time to work with and they were still able to work something out. Same day or next day passport and expedited visa and all that.

Relax and take a nice cold drink while you await your wife's oath letter. Her letter may even be on its way. Remember worries does nothing but just stress you out unnecessarily.

Best wishes!!!

The question is: can somebody request a certain oath day explaining the circumstances? Or, they never listen?

You can request a re-schedule. YES. It can delay the oath a couple of months and introduce complications if your residency numbers are borderline. And if you request, they will oblige.

But you can not request "a certain day". Some offices have same day oath (as interview), some do once a week, some once a month, so you will need to go along with the DO schedule.

#1. Move your timeline to the signature if you can.

#2. Don't worry. Even if you have 5 business days between oath and travel, you can do it with prior planning. As long as she gets oath by mid-December, you can work it in. Keep 2 business days free from office for SFO travel. Apply for a passport agency appointment around Dec 1st, most likely they will give you Dec 10th or so. If this does not work, keep trying everyday until you are in the 2 weeks expedited processing window, (and after your oath date). Take appointment before 10 AM in passport agency as well as before 10 AM for Travisa Visa outsourcing.

#3. If she gets oath on Dec 19 (random assumption), looks like you have no option but to re-schedule, unless you can swing both passport and visa in 1 day each with no chance for issues. I am presuming only Dec 22 and Dec 23 will be working, and any delay (even for 1 day) would create a situation you would not want to manage.

You have time, just wait and watch for a few days ...

Thank you all for your inputs.

For now, we will wait for one more week, and hopefully her oath letter arrives by then. If not, by mid-next we will take Infopass appt, and try to show up at USCIS office to at least check on status, if not request specific date.

I really hope we dont have to reschedule travel, since vacation time has been arranged from work for both of us, and each ticket (3 of us) has a $300 change/cancellation fee! Even if my wife gets oath in December, we will try our best to get same day passport and India visa. Still cheaper and less hassle than canceling the trip.

If need be you can always reschedule her oath ceremony instead of changing the tickets. I think your plan is sound, wait for now and if you don't hear anything schedule an Infopass. USCIS doesn't schedule (as far as I know) oath ceremonies (or interviews) during the Christmas holidays.
