I called NVC this morning, When I input my I-140 EAC#, automatic system said I input invalid number, after that, I called again operater told me, My case send to china, becaure my lawyer didn\'t respone packet 3, my lawyer told me he hasn\'t receive packet 3,I-140 approval date Nov 5,2001, quest is

1.Why NVC automatic system said my EAC# is invalid? and operater told me my case already send to china, what going on between 2 answer?

2.when NVC got case from VSC,(approval notice say I need to wait 90 days to call NVC) It will take how long to send out packet 3?

3.will give how long to my lawyer to respone packet 3?

4.I send I-485 & EAD to VSC on NOV 20, I still waiting for receipt,If case already send to china, is any possible will delay my I-485 & EAD receipt.

as follows

AVM would say you have an invalid number if your case is not there, in some cases.

If you do not respond packet 3 within 1 month, usually your case will be sent to the consulate where your got your visa.

It takes ca. 1-2 months for NVC to send you packet 3.

NVC gives you 4 weeks to respond packet 3.

Absolutely your 485 will be delayed, but not for your EAD.

hi, I just called NVC again, the lady tell me Packet 3 and case send out same day, do you believe that? I also asked her why When I input EAC# the automatic system will said my input invalid # ,she said mayble the system want me to put case #. but final I sure my case already send to china, she also tell me need to call VSC and call china to get back my case.

That is ridiculous

You are supposed to have time to respond packet 3 before they send the application to China. Are you sure that lady really found your case was in China? I mean, you should use a case number derived in NVC (which start with the name of the consulate followed a number), not VSC (which starts EAC...). Your lawyer must have got this number, which is a reference to contact NVC. Maybe you eac number works too, not quite sure.

You do not have to call the consulate or even VSC to get it back. It won\'t help. The consulate would say they send it back to VSC only at the request of it; and the VSC would say you just wait and they would do everything.

yes, I sure,I feel ridiculous too,I also asked her if case already send to china, packet 3 can\'t help me anything, and she said packet 3 will show lawyer how to handle, yesterday and today 2 difference lady answer me, the answer is same, my case and packet 3 same out same day.I tell her my I-140 EAC# first, and She also tell me case no.

this morning I call NVC again, and I heard defference thing, when I input my case no (no EAC#),the automatic system said my packet 3 send to lawyer on dec 3, and allow 4-6 week to deliver and follow the instruction, when paper work all done, final send to china.
that mean my case already send to china. I also call VSC, the lady said don\'t worry, When my case current VSC will call back my case from China.
