Nunc Pro Tunc asylum Granted .... now what ?

Hi Everyone I had applied for (i485) for GC based on asylum granted from my Dad, but pass the one year window.
As we know I was pass the one year limit to readjust, so i received a letter stating that i needed to apply for a Asylum Nunc Pro Tunc.
So i did. On 10/9/09 my Nunc Pro Tunc Asylum was granted, while the i485 was still pending.
Ever since nothing.....? what should i do ? what are the next steps???
I have a year to readjust again but i already have a i485 pending.....? do i need to fill up nother i485???

When you got your Nun Pro Tunc approved, you were supposed to send a copy of the approval letter to the office holding your greencard application. The asylum office has jurisdiction over asylum cases, and once they approve your NPT, their job is done. The USCIS office which has your greencard application need a prove that your asylum is approved. So if you don't inform them of your new status, then they have no way of knowing about it. If is like when you become citizen, you need to update your status with certain offices.

Any way I had the same experience. Once I submitted the copy of my nunc to pro approval, I got my greencard in 30 days. When you are sending the copy of your approval, alway attack one of those correspondence by the uscis with the barcode. good luck

Nun Pro Tunc is required:
if you were sponsered by your wife or husband as a deravitive asylee, or
you were sponsered by your parents while you were under 21, and you become over 21 when you file for greencard;

there were some law changes in recent years, and I am not sure how that affected the over 21 rule....
 
faysal, I was already over 21 when I received my derivative asylee status and I filed for my GC a month ago...Am I supposed to file for Nunc Pro Tunc?

It is hard to say. These days they are processing greencards faster; so they will tell you pretty soon if you have to do it or not. If there is an asylum office that is close by to you, you may also ask them whether you need it or not. In each case, you are ganna be ok

What do you mean by sponsored? I received a derivative asylee status through my dad.

That is how it used to be, but there was a law that was passed in 2003 that has to do with deravative asylees.

There was a problew for example, if you sponsor your child at age of 19 and while the visa is in process the child reaches 21, the child would age out, which essentially means the child is no longer elligible for visa. In 2003 the law was changed to protect children like that. Parents were allowed to bring their children as long as the petition was filed while the child was still under 21. even the child is 26 he can get visa as long as the petition was filed before 21.

I don't if this law protects aging out for the purpose of greencard. thankful is very knowledgable, but he is no longer with us. If there is an asylum office close to you, you check with them or you may wait the uscis says about your status. You will either get greencard through the mail, or they ask you to do the nun protucn thing....in each case you are gann be ok....good luck
 
According to thankful, I should be good since I'm covered by CSPA but I just wanted to confirm that's all. Since Garov said he had filed for Nunc Pro Tunc, I was curious, that's all. Wonder why he filed for Nunc Pro Tunc.
