NSC - Two Question

Hi all,

I have two seperate questions.

1. Does you guys know what PD is going in NSC? I heared from one of my friend, that from Jan 1st, 2005, 485 will be approved based on PD? is it so? IF so, my PD of the Labor is August 2003, so when my case may be approved. Aslo they (NSC) are not processing the cases randomly - is it true??

2. I did my FP on Nov 2004, but my status is not updated in the website.. whether it is common ? what is the common procedure for updating the FP status in the website..

Please resolve above issues..

P.D is not specific to the service center (NSC, CSC etc) ... it is established by DoS.
Current EB3 cut-off PD is Apr 1st, 2002.

Your friend is confused and is confusing you as well :)
*NOTHING* has changed from Jan 2005 -- your application was ALWAYS processed using 2 dates (PD and RD). All this time PD was current for all EB applications -- it was just recently that PDs retrogressed.

Reg Q2 -- for most people the web site status changes automatically within a week of doing FP ... there is a phone/fax number to check your FP status -- search this site.

If I am interpreting your first question correctly your friend definitely has a point that NSC is using PD these days for adjudication. I am not sure about the date from when it started though. I had a discussion with an Immigration Officer who mentioned the same. Previously they used the RD's as PD's were current but now they are following PD dates. Atleast that is what he said, do I take his words as mantra of adjudication...probably not...do I have better means of coming to a conclusion about the pattern of ajudication ....Absolutely not.

For the second question it is common and dont worry about this. We have enough worries already about this whole process.
 
NSC question

I think my PD is Aug 2003, please let me know when i can expect my green card.

Also what is FBI name check, when it will happen?

Presently only EB3( &Other) applicants from India, China & Philippines are subject to the PD backlog.
So if your case is not EB3, then you are not affected -- what's your case type ??

As I said before, current PD cutoff is Apr 2002 -- your PD is Aug 2003 -- so you have quite some time (atleast a year at the current rate) for approval.

Of course nobody can predict the movement of PDs ... so hope for the best -- maybe you'll be done sooner :)
