03/29/2005: NSC to Process I-140 and I-485 Separately
AILA has reported that the NSC will process the I-140 petition and I-485 application by separate adjudicators with the expectation that the separate teams will develop expertise in each form and speed up adjudication so that it will achieve the I-140 processing times in six months by the end of September 2005.
I-485 applications, regardless of concurrent filing or stand-alone I-485 filing, will be adjudicated starting the oldest cases.
For the concurrently filed I-140/I-485 applicants whose visa number has retrogressed and is not available, NSC will continue to adjudicate pending I-140 petitions in the following fashions:
If I-140 is approved, I-485 applications will be stored for the future call up date for pick-up and processing when the visa number becomes available.
If I-140 is denied, I-485 application will also be returned to the applicant.
Ever since the USCIS rescinded its concurrent adjudication policy, the processing times for NSC I-140 and I-485 have shown some improvement. Way to go, NSC!
